Please read the following Terms of Service carefully. By offering to hire the artist for a project you signify that you have read and agree with these Terms of Service. You must agree with these Terms of Service in order to hire the artist (henceforth known as “I”, “me” or “Dave Terry”).

Changes to These Terms

On a per-project basis, changes to any of these terms may be made before progress on the project begins if all parties involved agree to the new terms. If proposed changes are not agreed on by all parties, all terms presented in these Terms of Service will apply as they are.

I may make changes to these default terms at any time without notice. Changes to these terms will not apply to projects which have been commissioned prior to changes to these terms but will apply to all projects commissioned after the changes have been made.

Service, Payment and Delivery

By hiring me, I will work on and eventually provide the client (henceforth known as “you”) with one artistic project which will be discussed and agreed upon between you and me. The project will be completed within an agreed upon time frame. When the project is completed to the agreed upon parameters, you will pay me an agreed upon payment. If you change the parameters of the project after the previous parameters have been agreed upon, I may charge additional fees. After the project is completed, I will deliver the completed project to you in an electronic format within 1 day of receiving the total payment. I may withhold the completed project until payment is received. You may withhold complete payment until I provide proof that the project is completed. You have the right to view low-resolution (72 DPI or less) and “watermarked” electronic preview images of the project in progress at any time prior to the conclusion of our business.

Project Types

You may hire me for one of two types of project: Commercial or Personal. Terms, conditions and restrictions which apply to one type of project do not apply to the other unless explicitly stated so.

Commercial Projects

By hiring me for a Commercial Project, you agree that:

• The copyright of the completed project will be transferred to you upon my receiving of the agreed upon payment.
• You may use the completed project for any purpose within the boundaries of the law.
• I will not share or reuse any aspects of the project for which you hired me with any third parties without your permission.

Personal Projects

By hiring me for a Personal Project, you agree that:

• I will retain the copyright of the completed project.
• You may use the completed project for any form of private, home use within the boundaries of the law.
• You will not use the completed project for any form of commercial use or monetary gain.
• You will not publish, broadcast or mass distribute the completed project without my prior permission.
• I may share the completed project with any third parties and/or use the completed project in any portfolios.

Right of Refusal

I reserve the right to refuse to do business with anyone and to refuse to accept any project for any reason.
